Privacy Policy

Remaxan Privacy Policy

Effective Date: January 1, 2025

Remaxan is committed to protecting your personal data and privacy. This Privacy Policy explains how we collect, use, and protect your information when you use our global e-commerce platform, whether you are a buyer or a seller, in compliance with the Nigeria Data Protection Regulation (NDPR), the EU General Data Protection Regulation (GDPR), and other applicable data protection laws. By using Remaxan’s services, you agree to the practices described in this Privacy Policy.

Scope of This Privacy Policy

This Privacy Policy applies to all users of Remaxan’s platform worldwide. Remaxan welcomes buyers and sellers from around the globe, and we handle personal data in accordance with applicable laws in the regions where we operate.

Information We Collect

We collect personal information necessary to provide you with our services and to improve your experience. The types of data we may collect include:

  • Account Information: When you create an account as a buyer or seller, we collect information such as your name, username, password, email address, phone number, and contact details.

  • Identity and Verification Data: If you register as a seller or for certain transactions, we may ask for additional information to verify your identity (such as a government-issued ID, business registration details, or tax identification numbers) to comply with legal requirements.

  • Order and Payment Information: When you place an order or make a sale, we collect information related to the transaction. This includes shipping and billing addresses, items purchased or sold, payment method details (we do not store full credit card numbers or payment account access credentials—these may be handled by our payment processors), and transaction history.

  • Logistics and Shipping Information: For delivery of products, we collect the recipient’s name, shipping address, and contact phone or email. We use this data to ship orders via our third-party logistics partners internationally.

  • Usage Data: We collect information about how you interact with our platform. This includes your IP address, browser type, device information, pages viewed, dates and times of visits, and referral links. This data helps us improve our services and secure our platform.

  • Communications: If you contact us (for example, via customer support channels, email, or chat), we will collect the information you provide in these communications. This may include your name, email address, the content of your message, and any other details you choose to give us, so that we can respond to your inquiries and improve our services.

  • Cookies and Similar Technologies: Like most online platforms, Remaxan uses cookies and similar tracking technologies to remember your preferences, keep you logged in, and analyze site traffic. You can control cookies through your browser settings and other tools.

We collect personal data directly from you (for example, when you register or input your details at checkout) and indirectly through automated means (such as when your browser communicates with our platform).

Why We Collect Your Data and How We Use It

We use the collected information for the following purposes:

  • To Provide and Improve Our Services: We process your data to create and manage your account, facilitate purchases and sales, process payments, and ship orders. We also use your data to provide customer support and to improve the functionality and security of our platform.

  • To Communicate with You: We use contact information (like email or phone) to send service-related communications such as order confirmations, shipping notifications, and updates about your transactions. With your consent, we may also send marketing communications like special offers, newsletters, or product recommendations. You can opt out of marketing messages at any time.

  • To Enable Global Transactions: Because Remaxan operates internationally, we use your data to connect buyers and sellers worldwide. For example, address information is used to calculate shipping and deliver products to you, and seller information is used to display shop details and facilitate transactions.

  • To Ensure Compliance and Verify Identity: We may use identity and verification data to comply with legal obligations (for example, anti-fraud, anti-money laundering, or know-your-customer requirements) and to ensure users meet necessary qualifications (such as age requirements or seller eligibility).

  • To Personalize Your Experience: We may analyze your browsing and purchase history to personalize the content you see on our platform, such as suggesting products or tailoring the order of search results. This helps us make the platform more relevant to your interests.

  • For Security and Fraud Prevention: We use data (including usage data and certain personal identifiers) to protect the security of our platform, our users, and our business. This includes detecting and preventing fraud, abuse, security incidents, and other harmful activities.

  • Legal Obligations and Rights: In some cases, we must process personal data to comply with laws and regulations (e.g., maintaining transaction records for tax and financial reporting or responding to lawful requests by authorities). We may also process data to establish or defend legal claims.

We will not use your personal information for purposes that are incompatible with those disclosed at the time of collection or without updating you and obtaining any necessary consent.

Lawful Bases for Processing (GDPR/NDPR Compliance)

When we process personal data of individuals in certain jurisdictions, such as the European Economic Area or Nigeria, we do so under recognized legal bases. Depending on the context of your interactions and the applicable law, our processing of your data is justified by one or more of the following legal grounds:

  • Contract Performance: We process personal data to fulfill our contract with you. For example, when you buy or sell on Remaxan, we need to use your information to process payments and deliver orders as part of our agreement with you.

  • Consent: In cases where we ask for your consent (for instance, for receiving marketing communications or enabling certain cookies), we will process your personal data based on that consent. You have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

  • Legal Obligation: Some processing is necessary for us to comply with our legal and regulatory obligations. For example, we may retain transaction records to meet tax or accounting laws, or disclose information if required by a lawful order from authorities.

  • Legitimate Interests: We may process personal data for our legitimate business interests, such as improving our services, preventing fraud, or securing our systems – but only where those interests are not overridden by your rights and interests. Where applicable law (like NDPR) requires consent or does not allow a legitimate interest basis, we will rely on the required legal basis instead.

  • Vital Interests: In rare cases, we might process data to protect someone’s life or safety (for example, warning users of an urgent safety issue related to a product).

How We Share Your Information

We treat your personal data with care and confidentiality. We do not sell your personal data. However, we do share information in the following circumstances to run our global e-commerce services:

  • Service Providers: We use reputable third-party service providers to support our operations. This includes hosting providers who securely store data and power our website, payment processors to handle payment transactions, and analytics providers to help us understand how users engage with our platform. These third parties only access the information necessary to perform their functions and are contractually obligated to protect your data and use it only for the purposes we specify.

  • Logistics and Shipping Partners: To deliver products to you, we share necessary information (like your name, shipping address, and contact phone/email) with our third-party logistics and courier partners. They use this data only for shipping and delivery services. Remaxan ships internationally, so depending on your location and the seller’s location, your details will be provided to a trusted delivery partner to fulfill the order.

  • Business Partners and Sellers: If you purchase from a third-party seller on Remaxan, we provide that seller with the information needed to process your order (such as your name and shipping address). Similarly, if you are a seller, we share your shop name and public business information (and any other details you have provided for your seller profile) with buyers viewing your listings. Personal contact information of buyers and sellers is not disclosed publicly; it is used only as necessary between the transacting parties (for example, on an invoice or shipping label) or internally within Remaxan.

  • Legal Compliance and Protection: We may disclose personal information when required to do so by law or legal process. For instance, we might share data in response to a court order, subpoena, or other lawful government request. We may also share information if necessary to enforce our Terms of Service or other agreements, or to protect the rights, property, or safety of Remaxan, our users, or others (for example, to prevent fraud or address security issues).

  • Corporate Transactions: If Remaxan is involved in a merger, acquisition, reorganization, or sale of all or some of its assets, personal data may be transferred to the parties involved in the transaction. In such cases, we will ensure that the recipient of the data is bound to respect your personal information in a manner consistent with this Privacy Policy.

In all cases, we share the minimum information necessary for the purpose and we require recipients to handle personal data with an appropriate level of security and confidentiality.

International Data Transfers

Remaxan operates a global platform. Your personal data may be transferred to and stored on servers located in countries other than your own. For example, information collected within Nigeria or the European Union might be processed on servers in other regions. We use reputable third-party hosting providers with robust security measures, and regardless of where your data is processed, we protect it under the standards described in this Privacy Policy.

When transferring personal data out of Nigeria, the European Economic Area (EEA), or other regions with data transfer restrictions, we take steps to ensure appropriate safeguards are in place. This may include using standard contractual clauses approved by regulators, relying on countries with adequate data protection laws, or other lawful transfer mechanisms. Our goal is to ensure your personal data remains protected according to the requirements of NDPR, GDPR, and other applicable international standards, even when processed in a different country.

Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. For example:

  • Account information is kept for as long as your account is active. If you close your account, we will delete or anonymize your personal data within a reasonable period, except for information we are required to retain for legal purposes.

  • Transaction records, invoices, and related correspondence may be retained as required by law (such as tax and accounting regulations) and to resolve any disputes.

  • Information collected for verification or compliance (such as know-your-customer documentation) is retained only for as long as required by law or necessary for compliance.

  • Usage data (if linked to a user) is typically retained for a shorter period, unless it is used for security, fraud prevention, or analytics. When used for analytics, we may aggregate or anonymize data so it no longer identifies an individual, to use for long-term trend analysis.

After the applicable retention period, we will either securely delete or anonymize personal data. If deletion or anonymization is not feasible (for example, if data is stored in backup archives), we will securely store the data and isolate it from any further use until deletion is possible.

Data Security

We take the security of your personal information seriously. Remaxan employs administrative, physical, and technical measures to protect your data from unauthorized access, loss, misuse, or alteration. These measures include encryption of data during transmission (for example, secure HTTPS connections), strict access controls to our systems and databases, and regular security assessments of our platform. Our use of reputable third-party hosting providers means your data is stored in secure facilities with high standards of protection.

While we strive to safeguard your personal data, no Internet or electronic transmission is completely secure. You can help protect your information by using a strong, unique password for your Remaxan account and keeping your login credentials confidential. Please notify us immediately if you suspect any unauthorized access to or use of your account or personal data.

Your Rights and Choices

Depending on your location and applicable data protection laws, you have certain rights regarding your personal data. Remaxan is committed to upholding these rights for all users, subject to legal limitations. These rights may include:

  • Access and Portability: You have the right to request a copy of the personal data we hold about you, and to obtain it in a structured, commonly used, and machine-readable format. This allows you to review the information and, if desired, transfer it to another service.

  • Rectification: If any of your information is incorrect or incomplete, you have the right to request that we correct or update it. You can also update certain personal data directly by logging into your Remaxan account settings.

  • Erasure: You can request that we delete your personal data if it is no longer necessary for the purposes for which it was collected or if you believe it is being processed unlawfully. We will honor valid deletion requests provided we do not have an overriding legal obligation or legitimate reason to retain the information (for example, certain transaction data may need to be kept for financial reporting).

  • Withdrawal of Consent: Where we rely on your consent to process personal data (such as for marketing emails or optional data collection), you have the right to withdraw that consent at any time. Withdrawing consent will not affect the lawfulness of any processing we conducted prior to your withdrawal.

  • Objection and Restriction: You may have the right to object to our processing of your personal data, or request that we restrict certain processing, in particular if we are processing your data based on legitimate interests or for direct marketing. For example, you can ask us to stop using your data for marketing purposes at any time. In some cases, you can also request that we temporarily limit the use of your data (for instance, while we verify a concern you have raised about its accuracy or usage).

  • Lodging a Complaint: If you believe your data protection rights have been violated, you have the right to file a complaint with a supervisory authority. For instance, if you are in the EU, you can contact your country’s data protection authority. If you are in Nigeria, you can contact the Nigerian Data Protection Bureau (or its successor regulatory body). We would, however, appreciate the chance to address your concerns directly before you do so, and welcome you to contact us with any issues.

We will respond to and address any legitimate requests to exercise these rights within the timeframe required by law (for example, under GDPR we generally have one month to respond). To exercise your rights or for any privacy-related requests, please reach out to us using the contact information provided in the Contact Us section below. We may need to verify your identity before fulfilling certain requests, to protect your security and privacy.

Children’s Privacy

Remaxan’s services are not directed to children, and we do not knowingly collect personal information from anyone under the age of 16 (or under 13 in Nigeria, in accordance with NDPR) without verifiable parental consent. If you are a parent or guardian and believe that a child under the relevant age has provided us with personal data, please contact us. We will take steps to promptly delete the information and terminate the child’s account if one exists.

Updates to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will provide notice (for example, by email or by placing a prominent notice on our website) before the changes take effect. The Effective Date at the top of this policy indicates when the policy was last revised. We encourage you to review this page periodically to stay informed about how we protect your personal data.
